These Terms of Use effective from 1st December 2023 (v1.0.1.12), govern your use of Tsundoku services for individuals, including any associated software applications and websites (collectively, “Services”). This agreement between you and Agamika App labs PVT LTD (called Agamika hence), a Pune based company, includes our Service Terms and dispute resolution provisions. Your use of our Services implies your agreement with these Terms.
If you are in the European Economic Area, Switzerland, or the UK, additional terms may apply to your use of the Services. (see here)
Our Privacy Policy details how we collect and use personal information. While not part of these Terms, it's crucial to read.
Registration and Access
Minimum Age:
To use the Services, you must be at least 13 years old or the minimum age required in your country. If under 18, you need your parent or legal guardian’s permission.
Registration:
Provide accurate details to register for an account. Don't share your credentials, and you're responsible for all activities under your account. If acting on behalf of someone else, ensure authority to accept these Terms.
Utilizing Our Services
Permissible Actions:
You're granted access and use of our Services while adhering to laws, our policies, and provided guidelines.
Prohibited Actions:
Illegal, harmful, or abusive activities are strictly forbidden. This includes infringing on others' rights, modifying our Services, attempting reverse engineering, and more.
Software:
Our Services may allow software downloads, subject to automatic updates and open source licenses.
Third Party Services:
Integration of Third Party Services is subject to their terms, and we're not responsible for them.
Feedback:
We appreciate feedback and may use it without restriction.
Content
Your Content:
You can submit Input and receive Output. It's your responsibility to ensure Content complies with laws and these Terms.
Your Responsibilities:
You affirm that you have the necessary rights to provide Input.
Our Intellectual Property Rights
Ownership:
We and our affiliates exclusively own all rights to the Services.
Limited Use of Name and Logo:
You can use our name and logo following our Brand Guidelines.
Termination and Suspension
Termination:
You can stop using our Services anytime. We may suspend or terminate for breaches, legal compliance, or potential harm. Inactive accounts may be terminated after a year.
Appeals:
You can appeal account suspension or termination by contacting Support.
Discontinuation of Services
We'll give advance notice and refund prepaid, unused Services if we discontinue them.
Disclaimer of Warranties
Our Services are provided "as is." We don't guarantee uninterrupted or error-free services. Using Output is at your own risk.
Limitation of Liability
We and our affiliates won't be liable for indirect damages. Our total liability won't exceed what you paid in the last 12 months. These limits follow applicable law.
Indemnity
If you're a business, you'll indemnify us for third-party claims related to your use of the Services.
Dispute Resolution
Mandatory Arbitration:
Disputes are resolved through arbitration. You can opt out within 30 days. Informal resolution is attempted before arbitration.
Arbitration Procedures:
Arbitration is preferably via videoconference. Exceptions exist for small claims and injunctive relief.
Class and Jury Trial Waivers:
Disputes must be on an individual basis. Class actions and jury trials are waived.
General Terms
Assignment:
You can't transfer rights; we can.
Changes to Terms or Services:
We may update Terms and Services. Material changes give you 30 days' notice.
Delay in Enforcing Terms:
Our failure to enforce a provision doesn't waive the right to do so later.
Trade Controls:
Comply with trade laws. Our Services may not be used in embargoed regions.
Entire Agreement:
These Terms constitute the entire agreement.
Governing Law:
Indian law governs, except as provided in the dispute resolution section.
